  • Materials: content, videos, text, graphics, postings and other submissions and information of any kind and in whatever medium or format for access, viewing, use and commentary by other users to the site. 
  • Permitted Use: Materials on our website may be used for educational purposes and for conducting personal or communal rituals led in person to family, friends and congregants, subject to the restrictions herein.
  • Author: the creator of the Materials submitted.
  • Contributor: the individual or organization that uploads or posts the Materials to the website.

A) Certain features of the site allow you to contribute Material. We may also make Materials available for Permitted Uses by other users to the site.  Material on our website may only be used for Permitted Uses as outlined in this Terms. Notwithstanding contents in the rest of these Terms, you may not use the Material on the site: 

(i) in any manner that suggests an affiliation with Ritualwell or an endorsement by Ritualwell; 

(ii) for purposes inconsistent with the mission, goals or intentions of Ritualwell; 

(iii) in any manner that encourages persons not known to you or not part of your organization to download, adapt, distribute or otherwise use such Material; or 

(iv) in any manner that competes with or offers information and services similar to those of Ritualwell, including in connection with any person or entity that seeks similar funding or other resources as Ritualwell or otherwise solicits a charitable contribution or generates revenue. 

Any Material that contains or depicts a ritual or other activities of any congregation may only be reposted on such congregation’s website, or its affiliated websites, as determined by such congregation in its sole discretion.  

If there is any doubt about your proposed use of Material on this site, you should seek permission from the contributor, from the original author, or from Ritualwell, as applicable.  If you would like to request another use (other than the Permitted Use), or if you have any questions, please contact us at ritualwell@rrc.edu.

B) Any and all Material being reprinted from Ritualwell.org for the Permitted Use must acknowledge the authors' name(s) and the name of this site, www.ritualwell.org. You may print, download, and store information from this site for the Permitted Use described herein, but you may not copy, distribute, re-publish to sell or exploit any Material for commercial or any other purpose without the express written consent of Ritualwell. In the event that you link to this site for purposes that are consistent with these Terms, you must credit the author and include the note, “Originally published on Ritualwell.org.” If you do create a link to a page of this site, you do so at your own risk and the exclusions and limitations set out herein will apply to your use of this site.  You accept these Terms by creating a link to this site.

C) By submitting your Material to Ritualwell.org or with the continued posting of any Material previously submitted, you are giving us a limited, transferable, irrevocable, fully paid, non-exclusive and worldwide license to use your Material on our site. You are also giving permission to all Ritualwell.org third-party users to use it for the Permitted Use. By giving permission, you warrant that all Material submitted to this site by you is:

  1. owned or licensed by you or you otherwise have the valid right to provide;
  2. does not, violate copyright, trademark, patent, trade secret laws or other proprietary rights of a third party;
  3. does not contain any viruses, or other computer programming routines that damage or detrimentally interfere with any system, data or personal information; or
  4. constitutes disclosure of any confidential or proprietary information owned by any third party.  

Although you may incorporate Materials posted on Ritualwell.org into your private rituals you agree that Ritualwell.org reserves the right to restrict any use determined to be inappropriate by Ritualwell.org, in violation of these Terms, or outside the purpose of this site.

D) If you are sharing Material created or owned by other people, you must provide appropriate credit on your submission and obtain the originator's permission before submitting your Material. By submitting Material to Ritualwell.org or with the continued posting of your Material, you warrant and represent that you are capable of granting all rights found in these Terms to Ritualwell.org and any third-party users. If we are asked by a person claiming to own Material that you posted without their permission, it is our policy that we will remove the Material until ownership is clarified. Further, you acknowledge that all posted information, including personally identifiable information, is shared voluntarily. You are responsible for the content of the Material and agree to defend, indemnify and hold Ritualwell.org harmless for any damages, losses, costs, or expenses including reasonable attorneys’ fees, which we may incur as a result of the posted information. These Terms apply to all Material posted on Ritualwell.org, except as otherwise agreed in writing.

E) Using our website does not give you ownership of any intellectual property rights in the Material you access or view. If you print, link to or otherwise use any Material from this site, you agree not to remove or alter any copyright notice or any other proprietary notice on any Materials. 

F) We do not routinely monitor or review the content of other party’s websites which are linked to from this site. Opinions expressed or Material appearing on such websites are not necessarily shared or endorsed by Ritualwell.org, and Ritualwell.org should not be regarded as the publisher of such opinions or Material. Ritualwell.org is not responsible for the privacy practices or content of these sites. We encourage our users to be aware when they leave our site and to read the privacy statements of these sites. You should evaluate for yourself the security and trustworthiness of any other site connected to this site or accessed through this site, before disclosing any personal information on these sites. Ritualwell.org will not accept any responsibility for any loss or damage in whatever manner, howsoever caused, resulting from your disclosure to third parties of personal information.

F) This site and all of the information it contains are provided to third-party users “as is” without warranty of any kind, whether express or implied. All implied warranties, including, without limitation, warranties of non-infringement, merchantability or fitness for a particular purpose are hereby expressly disclaimed. You agree that by accessing our site and using the information found on our site, you do so at your own risk. Neither Ritualwell.org nor any party involved in producing or using this site shall be liable for any damages, including without limitation, direct, incidental, consequential, indirect or punitive damages, arising out of access to, use of or inability to use this site, or any errors or omissions in the Materials. This limitation includes damages to to your computer equipment by any cause including but not limited to any viruses.

G) We reserve the right to promote any Material you submit to the site. Promotion includes mentions on the Ritualwell.org website and social media channels as well as in articles and interviews about Ritualwell. Unless Ritualwell receives prior written notification from you to limit use of the Material, your submission gives Ritualwell a limited license to use submitted Material for promotional purposes.

H) If you believe that any content offered on or through the website violates your privacy rights, intellectual property rights or any rights whatsoever, please send a comprehensive message to Ritualwell.org at <ritualwell@rrc.edu> detailing the following information: (i) your name and the name of your company, if any; (ii) your contact information, including your e-mail address; (iii) the nature and substance of your complaint, the specific rights at issue, and your basis for making the complaint, including the content or posting that is objectionable; and, in the event that your complaint alleges a violation of intellectual property rights, (iv) the following statement: “The statements, representations, and assertions made in this message are true, complete, and accurate and I have the full legal authority to make each and every such statement, representation, and assertion and to make and be granted any demand made in this message.”

I) These Terms represent the entire agreement between you and Ritualwell.org with respect to the subject matter hereof, and supersede any and all prior and contemporaneous written and oral representations, understandings, and agreements, express and implied. These Terms, and all matters related thereto, shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania and the laws of the United States, without giving effect to any choice of law rules. You agree that any action at law or in equity arising out of or relating to these Terms or the Ritualwell.org website shall be filed, and that venue properly lies, only in the state courts or federal courts located in Philadelphia, Pennsylvania. You hereby consent and submit to the exclusive personal jurisdiction thereof and waive any right to a trial by jury.  The waiver or failure of Ritualwell.org to exercise in any respect any right provided hereunder shall not be deemed a waiver of such right in the future or a waiver of any of other rights established under these Terms.  In the event one or more of the provisions of these Terms or the application thereof is found to be invalid or unenforceable to any extent, the remaining provisions shall continue in full force and effect. If any provision of these Terms are found to be so broad as to be unenforceable, such provision shall be interpreted to be only as broad as is enforceable.

J) Ritualwell.org may revise these Terms from time to time. Revised Terms will apply to the use and content of this site from the date of the publication of the revised Terms on the website. Please check this page regularly to ensure you are familiar with the current version.
